These Terms & Conditions apply to services provided by Honest Drain & Sewer LLC, including drain cleaning, sewer cleaning, sewer camera inspections, hydro jetting, root blockage service, diagnostic work, and related drain or sewer services.
By scheduling service, approving an estimate, signing a work authorization, accepting service, or making payment, the customer agrees to these Terms & Conditions.
1. Authorization to Perform Work
The customer authorizes Honest Drain & Sewer LLC to perform the services described in the approved estimate, work order, invoice, or service agreement.
The customer represents that they are the property owner, authorized agent, landlord, property manager, tenant with proper authorization, or another person legally allowed to approve the requested work.
If the customer is not the property owner, the customer is responsible for obtaining proper authorization before work begins.
2. Scope of Work
Honest Drain & Sewer LLC will perform only the work specifically listed in the approved estimate, work order, or invoice.
Any work not specifically listed is excluded unless approved in writing.
Additional work, return visits, repairs, access creation, restoration, cleanup, replacement of defective piping, or work outside the original scope may require a separate estimate and additional charges.
3. Estimates and Pricing
Estimates are based on visible conditions, accessible piping, customer-provided information, and the apparent scope of work at the time the estimate is given.
Hidden conditions may change the scope and price of the work. These conditions may include, but are not limited to:
- Broken piping
- Collapsed piping
- Deteriorated piping
- Root intrusion
- Grease buildup
- Foreign objects
- Improper pitch
- Bellied piping
- Offset joints
- Inaccessible cleanouts
- Improper prior repairs
- Unsafe or unsanitary conditions
Honest Drain & Sewer LLC reserves the right to revise pricing if actual conditions differ from what was visible, accessible, or represented at the time of the estimate.
4. Payment Terms
Payment is due upon completion of service unless otherwise agreed in writing.
For larger jobs, deposits or progress payments may be required before work begins or as work progresses.
The customer is responsible for all approved charges, including labor, materials, equipment, disposal, diagnostic fees, after-hours charges, return visits, and additional approved services.
Unpaid balances may be subject to collection activity. The customer may be responsible for collection costs, attorney fees, court costs, and other recovery costs to the extent allowed by law.
5. Cancellations and Missed Appointments
Customers are expected to provide reasonable notice if they need to cancel or reschedule.
Honest Drain & Sewer LLC reserves the right to charge a dispatch fee, trip fee, or cancellation fee if a technician has already been dispatched, if access is unavailable, if the customer is not present, or if the customer cancels after arrival.
6. Drain and Sewer Cleaning Limitations
Drain and sewer cleaning is intended to restore flow through existing piping. It does not guarantee that the piping is in good condition or that the blockage will not return.
Drain and sewer issues may be caused by conditions outside of Honest Drain & Sewer LLC's control, including:
- Roots
- Grease
- Scale buildup
- Foreign objects
- Broken pipe
- Collapsed pipe
- Bellied pipe
- Offset joints
- Poor pipe pitch
- Deteriorated cast iron, clay, Orangeburg, PVC, ABS, or other piping
- Improper installation
- Improper prior repairs
- Lack of proper cleanouts or access
Honest Drain & Sewer LLC is not responsible for recurring blockages caused by defective, damaged, deteriorated, improperly installed, or compromised piping.
7. Pre-Existing Conditions and Hidden Defects
The customer understands that drain and sewer systems may contain hidden defects that are not visible before work begins.
Honest Drain & Sewer LLC is not responsible for damage, failure, leaks, backups, pipe collapse, fixture damage, or additional repairs caused by pre-existing conditions, hidden defects, defective materials, improper installation, deterioration, corrosion, root intrusion, prior improper work, or conditions outside the company's control.
If pre-existing defects are discovered, additional work may be recommended and quoted separately.
8. Equipment Use and Risk
Drain cleaning machines, sewer cables, cutting heads, hydro jetting equipment, sewer cameras, pumps, hoses, and related equipment may apply force to existing piping systems.
Older, weakened, deteriorated, improperly installed, root-damaged, cracked, collapsed, or defective piping may fail during cleaning, jetting, or inspection.
Honest Drain & Sewer LLC is not responsible for pipe failure, leakage, collapse, separation, or damage caused by pre-existing weakness, hidden defects, improper installation, or deterioration.
9. Hydro Jetting
Hydro jetting uses high-pressure water to clean drain and sewer lines.
The customer understands that hydro jetting may reveal or worsen existing defects in compromised piping. Hydro jetting is not a pipe repair and does not correct broken, collapsed, bellied, offset, deteriorated, or improperly pitched piping.
Honest Drain & Sewer LLC may refuse to hydro jet a line if conditions appear unsafe, unsuitable, or likely to cause damage.
10. Sewer Camera Inspections
Camera inspections are visual inspections of accessible piping only.
Camera inspections may identify visible issues such as roots, grease, debris, standing water, pipe separation, breaks, offsets, or deterioration. However, camera inspections do not guarantee that every defect will be found.
Visibility may be limited by water, grease, sludge, debris, pipe condition, turns, access limitations, lighting, or blockage.
Camera inspection findings are professional observations and are not engineering reports.
11. Access and Cleanouts
The customer is responsible for providing safe and reasonable access to the work area, fixtures, cleanouts, sewer access points, basement areas, crawlspaces, mechanical rooms, and exterior areas.
If proper access is unavailable, additional charges may apply for additional labor, equipment, access work, or return visits.
Honest Drain & Sewer LLC is not responsible for damage to defective, rusted, seized, brittle, improperly installed, concealed, or inaccessible cleanouts, caps, fixtures, piping, flooring, walls, ceilings, or surrounding materials.
12. Excluded Work
Unless specifically included in writing, the following are excluded:
- Plumbing repairs
- Pipe replacement
- Excavation
- Concrete cutting, removal, or replacement
- Wall, ceiling, or floor opening and restoration
- Drywall, plaster, paint, tile, flooring, landscaping, paving, or finish restoration
- Mold remediation
- Sewage cleanup
- Water damage cleanup
- Permits
- Engineering
- Code upgrades
- Septic system repairs
- Municipal sewer repairs
- Utility locating
- Electrical work
- HVAC work
- Structural repairs
If excluded work is needed, Honest Drain & Sewer LLC may recommend a separate estimate, licensed trade professional, restoration company, or appropriate specialist.
13. Water Damage, Sewage, and Contamination
Drain and sewer backups may involve sewage, wastewater, bacteria, mold risk, property damage, and contamination.
Honest Drain & Sewer LLC is not a water mitigation, mold remediation, or restoration company unless specifically stated in writing.
The customer is responsible for cleanup, disinfection, drying, property restoration, and contacting appropriate remediation professionals when needed.
14. Customer Responsibilities
The customer is responsible for:
- Providing accurate information
- Disclosing prior issues, prior repairs, known defects, and recurring problems
- Providing safe access
- Removing personal belongings from the work area
- Securing pets and children
- Obtaining landlord, owner, HOA, condo association, or property management approval when required
- Approving additional work before it begins
- Paying all approved charges
15. Tenant, Landlord, and Property Manager Authorization
For tenant-occupied properties, the customer authorizing the work represents that they have authority to do so.
If landlord, owner, property manager, HOA, or condo association approval is required, the customer is responsible for obtaining it before work begins.
Honest Drain & Sewer LLC may refuse to perform work until proper authorization is confirmed.
16. Permits, Licensing, and Code Compliance
Some work may require permits, inspections, utility marking, licensed trades, municipal approval, or code compliance.
Unless specifically stated in writing, permit fees, inspections, engineering, utility coordination, and code upgrades are not included in the estimate.
Honest Drain & Sewer LLC reserves the right to decline work that requires licensing, permits, approvals, or services outside the company's scope.
17. Change Orders and Additional Work
Any change to the original scope of work may require a written change order, revised estimate, or additional approval.
The customer agrees to pay for approved additional work, additional labor, materials, equipment, and related charges.
18. No Guarantee of Permanent Repair
Drain cleaning may restore flow temporarily or permanently depending on the cause of the blockage.
Unless a written warranty is specifically provided, Honest Drain & Sewer LLC does not guarantee that a blockage will not return.
Recurring issues caused by roots, grease, scale, foreign objects, defective piping, improper pitch, collapsed pipe, deteriorated piping, or other underlying conditions are not covered unless specifically stated in writing.
19. Warranties
Any warranty must be stated in writing on the estimate, invoice, or service agreement.
No verbal warranty is valid unless confirmed in writing.
Warranties do not cover:
- Abuse or misuse
- Foreign objects
- Grease buildup
- Root intrusion unless specifically stated
- Defective piping
- Collapsed or broken piping
- Improper installation
- Lack of proper maintenance
- Pre-existing conditions
- Customer-supplied materials
- Work performed by others
- Acts of God, flooding, freezing, ground movement, or other conditions outside the company's control
20. Photos, Videos, and Documentation
The customer authorizes Honest Drain & Sewer LLC to take photos, videos, and sewer camera footage of the work area, piping, equipment, site conditions, and completed work for documentation, estimating, training, quality control, insurance, and dispute resolution.
Honest Drain & Sewer LLC will not intentionally publish personally identifying customer information without permission.
21. Limitation of Liability
To the maximum extent permitted by law, Honest Drain & Sewer LLC is not liable for indirect, incidental, consequential, special, or punitive damages, including loss of use, lost income, loss of business, inconvenience, emotional distress, or damages resulting from pre-existing conditions, hidden defects, or conditions outside the company's control.
Nothing in these Terms & Conditions limits liability for gross negligence, intentional misconduct, or any liability that cannot legally be limited.
22. Hold Harmless and Indemnification
The customer agrees to hold harmless and indemnify Honest Drain & Sewer LLC, its owner, employees, subcontractors, representatives, and agents from claims, damages, losses, liabilities, costs, and expenses arising from:
- Pre-existing conditions
- Hidden defects
- Customer-provided misinformation
- Lack of proper authorization
- Unsafe or inaccessible work areas
- Defective piping
- Improper prior repairs
- Root intrusion
- Grease buildup
- Collapsed or deteriorated lines
- Water, sewage, or contamination conditions not directly caused by Honest Drain & Sewer LLC's negligence
- Work performed by others
This provision does not waive liability for damages directly caused by Honest Drain & Sewer LLC's gross negligence or willful misconduct.
23. Right to Refuse or Stop Service
Honest Drain & Sewer LLC reserves the right to refuse or stop work when conditions are unsafe, unsanitary beyond reasonable service conditions, outside the company's scope, not properly authorized, abusive, threatening, illegal, or likely to cause unreasonable risk.
24. Customer Cancellation Rights
Certain consumer transactions may be subject to cancellation rights under federal or state law.
Honest Drain & Sewer LLC will comply with applicable cancellation laws where required. Emergency service, customer-requested immediate service, scheduled service, and repair work may be treated differently depending on the facts and applicable law.
25. Disputes and Opportunity to Inspect
The customer agrees to notify Honest Drain & Sewer LLC promptly of any concern, dispute, or claimed issue related to the work.
Honest Drain & Sewer LLC must be given a reasonable opportunity to inspect the issue before the customer hires another contractor or performs additional work, unless an immediate emergency prevents doing so.
26. Governing Law
These Terms & Conditions are governed by the laws of the State of Rhode Island unless otherwise required by applicable law.
27. Entire Agreement
The approved estimate, work order, invoice, written change orders, and these Terms & Conditions make up the agreement between the customer and Honest Drain & Sewer LLC.
If any part of these Terms & Conditions is found unenforceable, the remaining sections remain in effect.
